In Bush Gore 00-949 five justices decided that the process
set out by The Constitution of the United States of America
had to be stopped. The five reasoned that the strong likelihood
that the contest in Florida would lead to the House of Representatives
having to decide who the next president would be. Although this nation
has used this Constitutional process in the past, this time it has not, only
because the five justices preferred that the decision not be made as
the Constitution prescribes. For this reason the first president not
having the benefit of the legitimacy derived from the faithful adherence
to that process will be inaugurated. The harm is done, yet the consequence
is not complete. In order to show faith to The Constitution for the United
States of America, it is necessary that those who have sworn to uphold
it in the highest court, but who have disallowed the process that great
document sets out,  be removed from that court. Only impeachment,
in the absence of some clear recognition by the five of their faithless act,
can  restore the nation to its anchor. [see service during good behavior]

Some will say that the outcome would have been the same, but that is
not true, for the House of Representatives has the power granted by
The Constitution that the court does not. The five justices, by denying
the process prescribed in The Constitution, denied the House of
Representatives its Constitutional part in the election process. Whether
or not members of the House want that part is not what is to determine
the process. Only The Constitution does that. Because the five were in
effect choosing a time when The Constitution should not apply, they
have proven faithless to the purpose for which they were seated.
Some will say this call for impeachment and removal of the five
is a lost cause. To this I can only say, if chances of success
determine our faithfulness, there is no moral cause in us. Let
historians not look in vain for some sign in this day that we cared
to correct if we could a terrible transgression.
